According to Article 641 of the Civil Code of Ukraine, this document is an official proposal (public offer) of a sole proprietor SP O. Karpov, acting on the basis of extracts from the Unified State Register of Legal Entities, Individual Entrepreneurs and Public Formations (hereinafter - the Travel Agent), to all users of http://chornobyl-tour.com/ and contains all the essential terms of a travel contract.

The performance of booking tourist services through the Internet site http://chornobyl-tour.com/by any person (hereinafter referred to as "the Tourist") indicates the acceptance (accept) by the User of all terms of this offer. The full and unconditional acceptance (accept) of this offer is the payment made by the Tourist on account of payment of the ordered Tourist Product (Tour).

1. DEFINITION OF TERMS

1.1. The site is a resource placed on the Internet at the link http://chornobyl-tour.com/, by means of which information about the booking services is provided to the User, their cost and payment procedure is displayed; also the date and time of the start / end of the tour; Characteristics of transport vehicles; and other related and ancillary services included in the cost.

1.2. Public offeris the offer of the Travel Agent to conclude an agreement on the implementation of the Tourism Product (Tour) with the Users, by accepting (accept) the terms of the offer.

1.3. Accept of the offer is full and unconditional acceptance of the terms of the offer by taking actions by the User, expressing his intention to use the Travel Agent's site for registration of his services.

1.4. A touristis a user of a site (a tour participant) who has accepted the offer personally or in the interest of a third party or third parties (hereinafter referred to as the "Tourist Group").

1.5. Guide is a person empowered with travel support.

1.6. Order (Application) is the tourist's request for tourist services according to the services selected on the site.

1.7. User is a capable individual who has reached the age of 18 years, has full civil capacity, legal right to enter into contractual relations with a Travel Agent.

1.8. Travel agentis a natural person-entrepreneur who legally publishes prices and terms of providing tourist services on the site.

1.9. ChEZ is Chernobyl Exclusion Zone.

1.10. Travel Product (Tour) is a placement-related visitor service that is not affiliated with the accommodation.

1.11. Tourist Product Price (Cost) is The Travel Agent's special offers listed on the site and / or other advertising agents of the Travel Agent that offer information about the cost of the Tour that the Tourist pays when purchasing the Tourist Product (Tour).

2. SUBJECT MATTER

2.1. The travel agent provides the implementation of tourist services (booking a tour, registration of passes to the ChEZ, ordering transportation services, etc.) in accordance with the order made by the tourist, and the tourist undertakes to pay the tourist product (tour) at the price set by the travel agent.

2.2. The public offer is considered concluded (acceptance of the offer), from the moment of pressing the button "SEND THE APPLICATION", having previously read and accepted its terms, by clicking "Marks", followed by the text "I am acquainted with and agree to the terms of the public offer",published on the site, is considered as the basic document in the official relationship between the Tourist and the Travel Agent.

3. CONDITIONS, ORDER OF ORGANIZATION AND PAYMENT OF THE TOURIST PRODUCT (TOUR)

3.1. Tours to the ChEZ (excluding air tours) are available only to persons who are 18 (eighteen) years of age and are carried out individually and / or part of a tour group. If there are seats available in the tourist group, bookings for the tour are accepted until 14:00 (the fourteen) hour of the day before the departure date.

3.2. After reading the information about the terms of the tourist service, which is posted on the site, the Tourist has the right at his own discretion to choose the Tourist product (Tour), posted by the Travel Agent on the site, at the price specified on the site for the duration of the offer through online access.

3.3. The order of the selected Tourist product (Tour) is made by pressing the button "SEND APPLICATION" according to item 2.2. of this offer.

3.4. In the process of confirming the selected order Tourist indicates the following personal data and agrees to their processing:

● first name, second name;

● date of birth;

● citizenship;

● passport number;

● mobile phone;

● Email.

3.5. The tourist is responsible for the correctness and validity of the data provided. In cases of incorrect data, the Travel Agent shall be released from liability for a possible ban on the entry of the Tourist to the ChEZ. In these situations, urgent changes to the Tourist's order may result in additional costs which the Tourist undertakes to compensate the Travel Agent prior to the start of the tour.

3.6. Before confirming and paying for an order on the site, the Tourist must be familiarized with the details and program of the tour, with the requirements for registration of entry and exit documents and rules of entry to the ChEZ and conditions of stay; compulsory insurance conditions; the date and time of the start and end of the tour; the price and procedure of payment; vehicle characteristics, rules of application, return and cancellation conditions.

3.7. After entering all the information in the application form, you will need to click the "SEND APPLICATION" button, then a message will appear that the application has been accepted and will be offered a choice of payment options provided by the service interkassa.comaccording to its conditions.

3.8. A travel product (Tour) is considered to be booked only after receiving an online order confirmation and / or notification from manager about money being transferred to the Travel Agent account.

3.9. The unpaid order is automatically canceled 4 (four) days after it is received by the Travel Agent.

3.10. Payment must be made within 3 (three) calendar days of placing the Tourism Product Order (Tour), but no later than 15:00 (fifteen) hour prior to the departure date.

3.11. In cases of payment in installments, the rest of the value of the Tourist product (Tour) must be paid before the moment of boarding of the Tourist to the vehicle. In this case, the value of the Tourist product (Tour) is only fixed upon receipt of the prepayment.

3.12. According to Part 2 of Art. 642 of the Civil Code of Ukraine, the fact of payment means acceptance of the public offer and unconditional consent of the Tourist with all relevant conditions, rules and restrictions related to the implementation of the Tourist Product (Tour).

3.13. Payment of all banking commissions on payments stipulated by the public offer shall be made at the expense of the Tourist.

3.14. The tourist is obliged to check the correctness of all the information stated in the received tourist product (Tour) order notification.

3.15. Travel agent services are provided in full, subject to full payment by the tourist of relevant tourist services.

3.16. To enter the ChEZ, the Tourist must be provided with the passport specified in the order. Tourists who do not have a passport are not allowed to board the vehicle.

3.17. Alcohol and drug abuse (hangover) are not allowed in the ChEZ;

3.18. During the tour it is forbidden:

● Alcohol and drug use;

● Violate radiation and physical safety standards;

● Ignore steering group requirements and guidelines.

4. RIGHTS AND OBLIGATIONS OF THE PARTIES

4.1. The travel agent undertakes:

4.1.1. to provide the Tourist with all necessary information regarding the Tourist Product (Tour) through information provided by the Tourist on the site;

4.1.2. to inform the Tourist immediately about circumstances that hinder or slow down the provision of tourist services;

4.1.3. to confirm payment for the tourist product by sending a letter to the tourist;

4.1.4. to inform the Tourist by e-mail or by telephone in case of impossibility to provide tourist services due to circumstances beyond the control of the Agent;

4.1.5. The travel agent shall not be liable to the Tourist, shall not refund the paid tourist services and compensation for moral damages for:

● late, incomplete or incorrect payment of the Tourist Product (Tour);

● untimely changes or cancellation of the tourist's order;

● for the non-appearance or delay of the Tourist (group of tourists) at the designated departure point;

● losses incurred by the Tourist (group of tourists) by third parties during the tour;

● storage of the luggage of the Tourist (tourist groups)

● discrepancy between the services provided and the unreasonable expectations of the Tourist (group of tourists) and his / her subjective assessment.

4.2. The tourist has the right and undertakes:

4.2.1. to refuse the ordered Tourist Product (Tour) taking into account the consequences provided for in Section 5 of this offer;

4.2.2. the free choice of tourist services when ordering a Tourist Product (Tour);

4.2.3. to pay, within the period specified in this offer, the cost of the Tourist Product (Tour);

4.2.4. observe the rules of stay in the ChEZ, do not violate public order, adhere to the rules of safety during transportation;

4.2.5. to arrive no later than 1 (one) hour before departure at the specified collection point;

4.2.6. to compensate the damage caused to the Travel Agent by his misconduct;

4.2.7. to compensate for losses in case of loss or mismatch of equipment and / or adaptations leased by the Tourist during the tour.

5. CANCELLATION OF THE TOURIST PRODUCT (TOUR) / RETURN OF PAYMENTS

5.1. The travel agent reserves the right to cancel the offer of tourist services and / or to refuse tourist services for the selected tourist services until the tourist makes full payment for the confirmed order.

5.2. Cancellation of a Tourist Product (Tour) on the initiative of a Tourist:

5.2.1. For more than 3 (three) days prior to the tour date, payment for the (Tourist Product (Tour) (net of commission) is refunded in full and / or credited to another available tour date;

5.2.2. Less than 3 (three) days before the tour date - The Travel Agent holds 25% (twenty-five) percent of the value of the Tourism Product (Tour), for the group of tourists and 50% (fifty) percent of the cost - for individual tours, the remainder payment with the deduction of the bank fee is returned to the Tourist.

5.2.3. In the case of making 100% prepayment, the Tourist can request a refund of 75% of the amount paid for the group tour, and 50% for the individual within 14 days after the end of the tour. Refund fee paid by Tourist.

5.3. For individual tours, in case of cancellation for a part of a group within less than 3 (three) days before the tour date, the final cost of the Tourist product (Tour) is not recalculated.

5.4. In case of the cancellation of the tour at will and / or the fault of the Tourist (group of tourists), the cost of the Tourist Product (Tour) is not compensated.

5.5. Changes to the plan of the visited places that were not the fault of the Travel Agent are not grounds for the refund of the Tourist Product (Tour).

5.6. In case of non-appearance of Tourist (group of tourists) to the meeting place - the cost of the Tourist product (Tour) will not be refunded.

5.7. In case of cancellation of a Tourist Product (Tour), the Travel Agent does not compensate for the costs associated with arrival to Ukraine of foreign tourists, accommodation and other expenses not related to the visit to the ChEZ.

6. RESPONSIBILITY OF THE PARTIES

6.1. The travel agent and the Tourist are responsible for the failure or improper fulfillment of the public offer obligations in accordance with the valid legislation.

6.2. The Travel Agent is not responsible for the inability to serve the Tourist for any independent reasons, including malfunction of communication lines, malfunction of the equipment, etc.

6.3. The travel agent is not responsible for violation of the terms of the public offer, if such violation is caused by force majeure circumstances (force majeure), including: actions of public authorities, fire, flood, earthquake, other natural acts, epidemics, lack of electricity and / or failure of work computer network, strikes, civil unrest, events that prevent the visit to the ChEZ, any other circumstances, not limited to, that may affect the travel agent's fulfillment of the terms of the public offer and not controlled by Travel Agent.

6.4. Disputes concerning the execution of a public offer arising out of the initiative of the Tourist shall be subject to consideration by the respective court at the location of the Travel Agent in compliance with the claim procedure. The claim in writing shall be forwarded to the travel agent's postal address.

6.5. All information provided by the Tourist when booking a tourist product must be true, accurate, current and complete. The tourist is responsible for the correctness of the information provided.

6.6. The Travel Agent is not responsible for the missed opportunity for the Consumption of paid tourist services, which arose as a result of changing the tourist's plans.

6.7. All claims, claims, related to improper provision of transportation, shall be submitted directly to the carrier, in accordance with the Rules of Provision of Passenger Road Transport Services;

7. TERM OF THE PUBLIC OFFER

7.1. A public offer becomes valid from the moment of its completion (acceptance of the offer) and is valid until complete fulfillment of all obligations of the Parties.

8. PROVISIONS ON PERSONAL DATA

8.1. In accordance with the Law of Ukraine "On Protection of Personal Data", the Parties consent to the processing, collection, registration, accumulation, indefinite storage, adaptation, modification, renewal, use, destruction, impersonation of personal data from primary sources (including passports data, information from documents (about education, marital status, family composition, place of residence, work experience, etc., information provided about the Customer and his relatives, etc.) in order to properly fulfill the requirements of the current legislation of Ukraine, protect the interests and rights of the parties, provision of civil legal relations, administrative law, tax relations and relations in the field of accounting and reporting etc.

8.2. Confirmation of consent to the use of personal data is the moment of acceptance of the offer by the User.

9. OTHER CONDITIONS

9.1. The travel agent has the right to make changes or additions to the terms of the public offer at any time without any special notice by posting a new version of the public offer at http://chornobyl-tour.com/.

9.2. The new revision of the terms of the public offering shall take effect upon its posting on http://chornobyl-tour.com/, unless otherwise provided by the new revision of the public offering.
